SoarFare Terms of Service

1. Acceptance of Terms

By accessing or using the SoarFare website, mobile application, or any service provided by SoarFare (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Subscription, Points, and Financial Terms

A. Subscription and Billing

  • Subscription: The Service is offered on a monthly subscription basis. By selecting a subscription tier, you authorize SoarFare to charge your designated payment method the recurring monthly fee.
  • Point Accrual: Monthly subscription fees are automatically converted into SoarFare Points (Points). Points are issued at a rate of $2.00 per point paid based on your chosen tier.
  • Cancellations: Subscribers may initiate a change to Frozen Status at any time through the Account Dashboard. Frozen Status immediately stops future billing but does not result in a refund for the current billing cycle. The subscription will remain in Frozen Status for a maximum of twelve (12) months. Upon the end of the twelve (12) month period in Frozen Status, the subscription will be automatically cancelled, and all accrued Points will expire pursuant to Section 2.C.

B. Point Redemption Value and Usage

  • Redemption Requirement (Active Status): Points can only be redeemed for travel services if the subscriber's account is covered by a currently active or frozen subscription, provided the subscriber meets the platform requirements for redemption (e.g., instant point purchase, payment of fees, etc.). If a subscription has been cancelled or is otherwise inactive, Points cannot be redeemed until a subscription is reactivated.
  • Point Value: Points may be redeemed for eligible travel services, including flights, hotels, and ancillary products. The value of travel services received per point redeemed is unified for all subscribers:
    • Points are redeemed at a rate of $1.70 per point toward the retail price of travel.

C. Point Expiration and Liability

  • Point Liability: SoarFare Points represent a future service obligation (deferred revenue) and do not constitute cash, currency, or property. They have no monetary value outside of the SoarFare platform.
  • Expiration: Points will expire if the subscriber's account remains inactive for a continuous period of twelve (12) months. Inactivity is defined as:
    • The subscription status is canceled (i.e., after the required 12-month Frozen Status period) or suspended.

3. Booking and Service Disclosures

  • Third-Party Bookings: SoarFare acts solely as an intermediary (Online Travel Agency) between the subscriber and third-party travel suppliers (airlines, hotels, car rental agencies, etc.). SoarFare is not the provider of the travel service.
  • Supplier Terms: All bookings are subject to the individual terms, conditions, and cancellation policies of the specific airline, hotel, or supplier. SoarFare is not liable for changes, cancellations, or errors made by the supplier.
  • Service Changes: The availability, point cost, and cash price of travel are dynamic and may change without notice.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOARFARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY BOOKING MADE THROUGH THE SERVICE.

SoarFare's total liability to any subscriber for any claim arising out of these Terms shall not exceed the total subscription fees paid by the subscriber in the twelve (12) months immediately preceding the date the claim arose.

5. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Utah.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration in Saratoga Springs, Utah County, rather than in court.
